Digital Gift Card Terms and Conditions

The Card is issued by LFC subject to these terms and conditions (the "Terms").

Definitions

“Business Day” means any day from Monday to Friday excluding bank or public holidays;

“Card” means the LFC Digital Gift Card, a prepaid online card denominated in British Pound Sterling upon which money is loaded at the time of purchase, or any replacement card which we issue to you from time to time. It is not a credit card, or a charge card, nor is it a debit card linked to a current account;

“Card Transaction” means any transaction whereby the Card is used to pay for goods and/or services through the LFC Store;

“LFC”, “we” and “us” means The Liverpool Football Club and Athletic Grounds Limited, a company incorporated and registered in England with company number 35668 whose registered office is at Anfield Road, Liverpool, Merseyside L4 0TH;

“LFC Store” means the LFC official online store found at https://store.liverpoolfc.com/; and

“UK” means the United Kingdom.

Contact Details

For lost or stolen Cards: please contact the LFC Customer Service Team if your Card is lost or stolen, the contact details for which can be found at https://faq.liverpoolfc.com/portal/en/kb/articles/contact-us. The full Card number will be required otherwise we cannot assist with any queries.

For balance enquiries: please enter your Card number at the checkout or log into your official LFC Store account which can be found at https://store.liverpoolfc.com/customer/account/login/.

For queries or disputes relating to previous transactions: please contact the LFC Customer Service Team, the contact details for which can be found at https://faq.liverpoolfc.com/portal/en/kb/articles/contact-us. Please note that the Card involved in the disputed transaction will be required to be presented otherwise we cannot assist with any queries.

Card

The use of the Card is subject to these Terms, which may be varied by us from time to time and use of the Card by you constitutes your acceptance of these Terms. Any variations to these Terms shall come into force from the moment of publication at the LFC Store. You are therefore invited to check the LFC Store regularly to verify any variations of these Terms.

If you do not agree to be bound by these Terms, then you should not purchase a Card.

Upon purchase, the Card will be sent to the email address nominated by you during the checkout process.

We will assume that the person using the Card is the rightful user of the Card.

The Card will normally be available for use from the date of purchase.

Please record your Card number and/or retain the purchase receipt as proof of purchase - the Card number will be needed to check or redeem your Card balance or if your Card is lost or stolen.

You may use the Card, in accordance with any instructions issued by us from time to time, until the Card balance reaches zero, at which time your right to use the Card will cease.

Other than where a Card is cancelled in accordance with these Terms, Cards are not refundable (whether for cash or otherwise).

Protecting Your Card

You are solely responsible for the safekeeping and security of your Card following purchase.

You must:

(a) treat the Card as if it were cash;

(b) take all reasonable care and precaution in the custody of the Card and keep your Card safe;

(c) keep your transaction receipts safe and dispose of them carefully; and

(d) never give your Card number or any other Card information to anyone unless you know who they are and why they need them.

Using Your Card

You may only use the Card through the LFC Store.

The Card cannot be used to buy other gift cards or vouchers and nor can it be redeemed or exchanged for cash. One or more Cards may be redeemed against a purchase. If the value of the purchase exceeds the amount on the Card(s), the balance must be paid by credit or debit card.

Please note that for combinations with other offers, restrictions may apply.

We will debit the amount of any Card Transactions from the balance remaining on the Card at the time the Card Transaction takes place. You must not use the Card to spend more than the Card balance at any time. If you attempt to spend more than the Card balance your transaction will be declined.

Our standard terms & conditions of sale will apply to all purchases made using the Card and all refunds/exchanges of goods purchased with the Card will be made in accordance with our normal refund policy. This does not affect your statutory rights.

You cannot stop a Card Transaction after it has been authorised.

We will not issue statements. You can obtain your Card balance by entering your Card number at the checkout or logging into your official LFC Store account which can be found at https://store.liverpoolfc.com/customer/account/login/. You are responsible for monitoring your Card balance and for ensuring that there are sufficient funds on the

Card always to pay for Card Transactions. The up-to-date Card balance will be available to view the same day.

If at any time, you believe that a Card Transaction has been incorrectly debited to your Card you should contact LFC Customer Service Team, the contact details for which can be found at https://faq.liverpoolfc.com/portal/en/kb/articles/contact-us. If requested, you must put your query in writing. We will investigate the applicable Card Transaction and, if we deem it correct and/or appropriate, reinstate the incorrectly debited amount on your Card on completion of our investigation unless we reasonably believe that you are responsible for the Card Transaction in question.

Changes

We reserve the right to update and change these Terms at any time. This does not affect your legal rights. Use of your Card constitutes acceptance of these Terms and we therefore recommend you read it carefully. It is your responsibility to check these Terms from time to time to ensure you are aware of any changes which may have been made.

Restrictions on Use of The Card

The following Card limits will apply:

Minimum Load Amount £5

Maximum Load Amount £1000 (this limit cannot be exceeded by performing balance transfers)

The amount you upload onto the Card must be in multiples of £1.

Please note that the Card belongs to us. We may, at our reasonable discretion and without prior notice to you, restrict the use or operation of the Card where:

- you are in breach of these Terms;

- we have reasonable grounds to suspect unauthorised use of the Card, fraud, theft, or dishonesty; or

- we have any legal, regulatory, or other objectively justifiable reason.

In such circumstances, we will be entitled to:

- block the use or operation of the Card;

- refuse to allow or authorise a Card Transaction;

- suspend, restrict, or terminate your right to use the Card;

- withdraw the Card;

- retain the Card;

- refuse to replace the Card; or

- take other such steps that we consider reasonably necessary.

These steps may be taken at any time without prior notice to you.

Where we take any such steps, we will notify you and give our reasons for doing so as soon as we are permitted to do so. Where the Card is blocked, and you believe it may be because of the circumstances above, please contact the LFC Customer Service Team the contact details for which can be found at https://faq.liverpoolfc.com/portal/en/kb/articles/contact-us and we will advise you as to how the block may be removed or will issue you with a replacement Card (if after our investigation we believe the relevant circumstances which described above no longer apply). We may ask you to return the Card to us (cut in half vertically).

You must not use the Card:

(a) if any notification of its withdrawal is given to you; or

(b) once the Card balance reaches zero; or

(c) as payment for any illegal purchase.

Restricted Transactions

The Card can be used for Card Transactions in the UK only. The Card may not be used in any other country or through any physical stores.

Redemption

From time to time, in order for you to use the Card and/or redeem any balance on the Card we may require you to submit documentation and/or evidence to us to verify your identity.

If you received this Card from a third party, we reserve the right to notify the applicable third party of a redemption request made by you.

You acknowledge and agree that when your Card is activated, your balance will be available for a maximum period of 12 (twelve) months, following which the balance on the

Card shall expire without any refund being due to you. Upon expiry any unused balance on the Card will be forfeited.

Theft, Loss, Misuse or Damage of Card

You should treat and protect the Card as if it were cash. You are solely responsible for the safe keeping and security of your Card following purchase. We cannot be held liable for lost or stolen Cards. We also cannot be held liable for any balance lost on a Card as a result of theft or fraud.

We cannot be held responsible for any unauthorised use where the Card number or any other Card information have become known to another party.

If the Card is lost, stolen, damaged or fails to operate correctly or if the Card number becomes known to any unauthorised person you must immediately notify the LFC

Customer Service Team, using the contact details which can be found at https://faq.liverpoolfc.com/portal/en/kb/articles/contact-us. You must present/quote the Card number in order to cancel the Card - if you do not present/quote the Card number, we will not be able to cancel the Card.

We are not responsible if a Card is lost, deleted or used without permission and we reserve the right not to accept any Card or otherwise limit the use of a Card if we reasonably believe that the use is unauthorised, fraudulent or otherwise unlawful.

Termination and Cancellation

You can exercise your right to cancel the purchase of your Card by giving us written notice within seven days from the day after the purchase date, provided that the Card has not already been used. Your right to cancel the purchase of the Card will come to an end immediately when the Card is used (in full or in part).

If your Card is cancelled we will immediately block your Card, so it cannot be used. Any funds remaining on your Card will be returned to you once all Card Transactions have been processed.

General

We will not be liable for any delay or failure in performing any of the obligations in respect of the Card, including without limitation any refunds resulting from incorrectly executed or unauthorised transactions, where such delay or failure occurs because of any abnormal or unforeseeable circumstances beyond our reasonable control, the consequences of which could not have been avoidable despite our efforts to the contrary, or where such delay or failure arose because of our obligations under any applicable law.

In the absence of an obvious error, the accounts and records kept by us shall constitute sufficient evidence of any facts or events relied upon by us in connection with any Card Transaction or matter or dealing in relation to the Card.

You agree that we may rely on our records of the use of the Card as sufficient evidence that the Card Transaction was authorised by you or that you have failed in gross negligence to keep your Card safe.

We may disclose details of the Card to any person acting as our agent in connection with the use or issue of the Card.

These Terms shall be governed by and interpreted in accordance with the laws of England and Wales and is subject to the exclusive jurisdiction of England and Wales.

All communications under these Terms will be in English.

Complaints

If you are not satisfied with any aspect of the service offered, please contact LFC’s Customer Services by following the link below to our fan’s services platform who will be pleased to help:faq.liverpoolfc.com.

We will try to resolve your complaint as soon as possible. However, the complaint may need to be investigated in further detail. In most cases we will provide a response to your complaint within one (1) Business Day after the day on which we receive your complaint. If we are not able to do so due to exceptional circumstances, we will provide you with a full response within fourteen (14) Business Days.

Please note that nothing in these Terms affect your rights at law (for instance, under the Consumer Rights Act 2015). Please see the Citizens Advice website at citizensadvice.org.uk for more details.

In-store Gift Card Terms and Conditions

The LFC Gift Card is not a credit card, or a charge card, nor is it a debit card linked to a current account. It is a prepaid card which means that money must be loaded onto the Card at the time of purchase. From the date of purchase, cardholders can use the Card to pay for purchases at a Participating Retailer. The Card is issued by Liverpool Football Club subject to these terms and conditions.

Certain limits apply to the Card. Only full £1/€1 amounts (or multiples thereof) may be loaded onto the Card. Additional amounts may be loaded onto the Card at any time. Interest will not be payable in respect of Card balances.

You should look after the Card as we do not hold your personal details and we cannot link the Card to you.

Definitions

“Agreement” means the Agreement between you and us which includes these terms and conditions.

“Business Day” means any day from Monday to Friday excluding bank or public holidays.

“Card” means the LFC Gift Card, a prepaid card denominated in Sterling/EURO, or any replacement card which we issue to you from time to time.

“Card Transaction” means any transaction whereby the Card is used to pay for goods and/or services at Participating Retailers.

“LFC”, “we” and “us” means The Liverpool Football Club and Athletic Grounds Limited.

“Participating Retailer” means a LFC Store of goods and/or services available in the UK/ROI which has agreed to accept the Card as payment for goods and/or services. A list of participating retailers can be found further on the T&C.

“ROI” means the Republic of Ireland.

“UK” means the United Kingdom.

Contact Details

For lost or stolen Cards:  Please contact the store in which the Gift card was purchased. The full card number will be required otherwise we cannot assist with any queries.

For balance enquiries, please visit a Participating Retailer.

For queries or disputes relating to previous transactions, please contact the Participating Retailer at which the Card was redeemed. Please note that the Card involved in the disputed transaction will be required to be presented otherwise we cannot assist with any queries.

Card

The use of the Card is subject to the terms of this Agreement, which may be varied by us from time to time. The current version of this Agreement is available on the Website here, and use of the Card constitutes acceptance of this Agreement.

The Card will not be personalised and the cardholders name will not be printed on the Card. The Card is transferable by delivery. We will assume, unless otherwise advised, that the person using the Card is the rightful user of the Card.

The Card will normally be available for use from the date of purchase.

Please record your Card number and/or retain the purchase receipt as proof of purchase - the Card number will be needed to check or redeem your Card balance or if your Card is lost or stolen.

You may use the Card, in accordance with any instructions issued by us from time to time, until the Card balance reaches zero, at which time this Agreement will automatically terminate and your right to use the Card will cease.

Card can only be redeemed in store.

Protecting Your Card

You must:

(a) treat the Card as if it were cash.

(b) take all reasonable care and precaution in the custody of the Card and keep your Card safe.

(c) keep your transaction receipts safe and dispose of them carefully; and

(d) never give your Card number or any other Card information to anyone unless you know who they are and why they need them.

We recommend that you protect your Card from scratches and exposure to magnets which may damage the Card and result in it not being readable when presented at a Participating Retailer as a form of payment.

Using Your Card

The Card may only be used in Participating Retailers. The up-to-date list of Participating Retailers is listed below. The list of Participating Retailers and how they accept the Card (in store only) may change from time to time. Please note that, unless set out in the list below, the card is not redeemable in any LFC Pop up store and/or via the official LFC online store.

Current Store List:

1.      Anfield Store, 181 Walton Breck Road;

2.      Liverpool One Store, Liverpool One;

3.      Williamson Square Store, Williamson Square;

4.      Chester Store, 42-44 Northgate Street;

5.      Belfast Store, 9 Castle Lane; and

6.      Dublin Store, Unit 15 ILAC Centre, Henry Street.

We will debit the amount of any Card Transactions from the balance remaining on  the Card at the time the Card Transaction takes place. You must not use the Card to spend more than the Card balance at any time. If you attempt to spend more than the Card balance your transaction will be declined.

You cannot stop a Card Transaction after it has been authorised. You authorise a Card Transaction by following the instructions provided by the Participating Retailer to authorise a transaction, which includes:

(a) swiping the Card over the card reader;

(b) where requested to do so, signing a receipt for the relevant Card Transaction;

(c) providing Card number and/or other details as requested.

The amount of the Card Transaction must be confirmed with the Participating Retailer at the time of authorisation.

We will not issue statements. You can obtain your Card balance by speaking to a member of staff at a Participating Retailer. You are responsible for monitoring your Card balance and for ensuring that there are sufficient funds on the Card always to pay for Card Transactions. The up-to-date Card balance will be available to view the same day.

If at any time you believe that a Card Transaction has been incorrectly debited to your Card you should contact the Participating Retailer at which the applicable Card Transaction was made. If requested, you must put your query in writing. We will investigate the applicable Card Transaction and, if we deem it correct and/or appropriate, reinstate the incorrectly debited amount on your Card on completion of our investigation unless we reasonably believe that you are responsible for the Card Transaction in question.

If the amount of a Card Transaction which you wish to make using your Card is greater than the available balance, you can pay the difference by any other payment method accepted.

Changes

We reserve the right always to introduce new terms and/or to vary or amend an existing term (including, without limitation, introduce new fees) by giving you at least two months’ notice thereof on the Website or by whatever means we, in accordance with applicable legislation, deem appropriate at that time. You will be deemed to have accepted such revised Agreement, unless you tell us that you do not agree to the change prior to the change taking effect. In such circumstance, your rejection of the change shall be treated as notification that you wish to terminate this Agreement and in such circumstances we will refund to you the balance on your Card.

The following Card limits will apply:

Please note that the Card belongs to us. We may, at our reasonable discretion and without prior notice to you, restrict the use or operation of the Card where:

This may include us, or any person acting on our behalf (including a Participating Retailer), retaining the Card at any time without notice to you.

Where we take any such steps, we will notify you and give our reasons for doing so as soon as we are permitted to do so when you contact us. Where the Card is blocked, and you believe it may be because of the circumstances above, please contact the Participating Retailer  you purchased the Card from and we will advise you as to how the block may be removed or will issue you with a replacement Card (if after our investigation we believe the relevant circumstances which described above no longer apply). We may ask you to return the Card to us (cut in half vertically).

You must not use the Card:

(a) if any notification of its withdrawal is given to you; or

(b) once the Card balance reaches zero; or

(c) as payment for any illegal purchase.

Restricted Transactions

The Card can be used for Card Transactions in the UK or the ROI only. The Card may not be used in any other country.

Redemption

From time to time, in order for you to use the Card and/or redeem any balance on the Card we may require you to submit documentation and/or evidence to us to verify your identity.

If you received this Card from a third party, we reserve the right to notify the applicable third party of a redemption request made by you.

In the ROI If you received this Card as part of the Governments annual Benefit in Kind allowance, we will not be able to process a refund directly to you or your employer as they may then be subject to a tax liability.

You acknowledge and agree that:

- where your Card is activated in the UK, your balance will be available for a maximum period of 12 (twelve) months; or

- where your Card is activated in ROI, your balance will be available for a maximum period of five (5) years,

following which the balance on the card shall expire without any refund being due to you.

Theft, Loss or Misuse Of Card

You should treat the Card as if it were cash. If the Card is lost, stolen, damaged or fails to operate correctly or if the Card number becomes known to any unauthorised person you must immediately notify the Participating Retailer at which you purchased the Card. You must present/quote the Card number in order to cancel the Card -  if you do not present/quote the Card number, we will not be able to cancel the Card.

Provided that you have not acted fraudulently or with gross negligence, you will remain liable for any debit to the Card arising from unauthorised use of the lost or stolen Card, If you have acted fraudulently, or without reasonable care you may be liable for the entire loss. You will not be able to claim a refund for any unauthorised transactions arising from use of a lost or stolen Card where you notified us of such.

Following notification, if there is a credit balance on the Card, we will cancel the original Card and will provide a replacement Card (with the appropriate credit loaded on to the replacement Card) to you at the address nominated by you. We cannot issue a replacement Card if you cannot tell us the original Card number.

If you subsequently find the original Card, you must notify us immediately, and you must not use the original Card.

Termination and Cancellation

We can terminate this Agreement for any reason by giving you at least 1 months’ notice on the Website or by whatever means we, in accordance with applicable legislation, deem appropriate at that time.

If your Card is cancelled or you have terminated this Agreement in accordance with any Clause, we will immediately block your Card, so it cannot be used. Any funds remaining on your Card will be returned to you once all Card Transactions have been processed.

Participating Retailers

 It will be necessary in all cases, for a Participating Retailer to obtain authorisation from us or our agents to honour the Card for a particular Card Transaction- this is to ensure that there are sufficient funds on the Card. We may refuse to authorise a Card Transaction at any time if there are insufficient funds on the Card.

If a Participating Retailer becomes liable to make a refund to you, the credit amount of any refund will be returned onto the same Card, or where we deem it appropriate a new Card will be issued. Please note that there will be no cash refunds given on transactions paid for using a Card.

General

The accounts and records kept by us shall, in the absence of an obvious error, constitute sufficient evidence of any facts or events relied upon by us in connection with any Card Transaction or matter or dealing in relation to the Card. 

You agree that we may rely on our records of the use of the Card as sufficient evidence that the Card Transaction was authorised by you or that you have failed in gross negligence to keep your Card safe.       

We may disclose details of the Card to any person acting as our agent in connection with the use or issue of the Card.

This Agreement shall be governed by and interpreted in accordance with the law of the England and is subject to the non-exclusive jurisdiction of England and Wales.
